「SWFX Trader JP」利用規約

この規約（以下、「本規約」という。）は、お客様にデューカスコピー・ジャパン株式会社（以下、「弊社」という。）が提供する「SWFX Trader JP」（iPhone、iPad、iPod touch 若しくは Android 搭載端末にダウンロードされるアプリであり、以下、総称して「本アプリ」という。）をご利用頂く際の取扱いにつき定めるものです。本アプリの利用に際しては、本規約の他、弊社が定める約款、取引説明書の定めに従うものとします。本規約に同意した上で本アプリをダウンロード、インストール又は利用してください。本規約にご同意頂けない場合は、本アプリを利用することはできませんので、直ちに本アプリのダウンロード、インストール又は利用を中止してください。本アプリをダウンロード、インストール又は利用する場合は、本規約に同意したものとみなします。
１．サービス概要
本アプリはお客様の iPhone、iPad、iPod touch 若しくは Android 搭載端末にダウンロードされた「SWFX Trader JP」を使用して、弊社のサービスをご利用頂くものです。
２．利用料金
本アプリの利用料金は無料です。但し、本アプリ利用に関するパケット通信料はお客様のご自身のご負担となります。また、本アプリからの取引注文に対しては、弊社が別途定める取引手数料が発生します。
３．利用環境
本アプリを利用できる対象機種・対象 OS は、弊社所定のものに限られます。
４．知的財産権
本アプリで提供される為替チャート、為替情報、ニュース等の情報（以下、「投資情報等」という。）及び本アプリの著作権等の知的財産権は、弊社又は正当な権利を有する第三者に帰属します。お客様は、本アプリの利用に限り本アプリを利用頂けます。また、お客様は本アプリ及び投資情報等の情報の転載・複製・改変及び本アプリのリコンパイル・リバースエンジニアリング並びにこれに類する行為を行うことはできません。
５．不保証
弊社が提供する投資情報等については、投資判断の参考となる情報提供を唯一の目的としております。情報提供については、万全を期しておりますが、その内容を保証するものではありません。提供される情報に基づいてお客様が不利益を被った場合であっても、弊社及び情報提供元は一切責任を負いません。
６．免責事項
本アプリのご利用に関して、以下の事由に基づき生じたお客様の損害について、弊社は一切の責任を負わないものとします。
（１）本アプリの不具合（表示情報の誤謬・逸脱、取引の不能等）による損害
（２）本アプリがお客様の携帯電話端末等に与える影響及び損害
（３）お客様が本アプリを正常に利用できないことにより生じた損害
（４）通信回線及びシステム機器等の瑕疵又は損害（天災地変等の不可抗力によるものも含みます。）、通信速度の低下又は通信回線の混雑、コンピュータウィルスや第三者からなされる請求により生じた損害
（５）弊社が定める約款、取引説明書に免責事項として定める損害
（６）弊社の責めによらずお客様のログイン ID、パスワード、PIN コードが漏えいしたことによる損害
７．利用停止と損害賠償
お客様は、本規約に定めるところに違反した場合は、弊社は直ちにお客様の本アプリ利用を停止できるものとします。また、当該違反行為により弊社が損害を被った場合は、弊社はお客様に対して損害賠償請求を行えるものとします。
８．規約等の変更
弊社は、お客様の承諾及びお客様への通知なしに、いつでも本アプリの中止・内容変更、本アプリのバージョンアップ、本規約の変更を行うことができるものとします。
９．準拠法及び裁判管轄
本アプリ利用に関し紛争が生じた場合には、東京地方裁判所を第一審の専属的合意管轄裁判所とし、本規約は日本国法に準じて解釈されます。
