La Constitution française du 4 octobre 1958 est l'actuelle constitution de la France et régit ainsi la Ve République française. Norme juridique suprême du pays, c'est l'une des plus stables qu'il ait connues.

En pleine guerre d'Algérie, elle a été rédigée dans l'objectif affiché de mettre un terme à l'instabilité gouvernementale et au risque de coup d'État militaire ; elle est marquée par le retour d'un exécutif fort. Deux hommes y ont notamment imprimé leurs idées : Michel Debré, inspiré du modèle britannique et de son Premier ministre fort, et le Général de Gaulle, entendant ériger le président de la République en garant des institutions conformément aux principes énoncés dans ses discours de Bayeux, le 16 juin 1946, et d'Épinal, le 29 septembre 1946.

Elle instaure un système politique à géométrie variable selon que l'on soit en période de concordance des majorités présidentielle et législative ou, au contraire, de cohabitation. En période de concordance, l'Assemblée nationale, le Premier ministre et son gouvernement ainsi que le président de la République sont du même bord politique : le président de la République exerce une autorité qui limite l'exercice des attributions constitutionnelles du Premier ministre. À l'inverse, en période de cohabitation, la lettre de la Constitution est mieux respectée (le président de la République François Mitterrand, soumis par deux fois à ce cas de figure, disait que « la cohabitation c'est la Constitution, rien que la Constitution mais toute la Constitution »)1.

Son préambule renvoie à deux textes fondamentaux la Déclaration des droits de l'homme et du citoyen du 26 août 1789 et le Préambule de la Constitution du 27 octobre 1946 (la Charte de l'environnement de 2004 leur a, par la suite, été ajoutée). Ces textes, ainsi que les principes jurisprudentiels qu'ils ont permis de dégager, notamment les principes fondamentaux reconnus par les lois de la République issus du Préambule de 1946, forment, avec la Constitution stricto sensu, ce qu'il est convenu d'appeler le bloc de constitutionnalité depuis que le Conseil constitutionnel a accordé valeur constitutionnelle au préambule de la Constitution en 19712.

Le Conseil constitutionnel vérifie la conformité des lois à la Constitution quand il en est saisi, avant leur promulgation ou par voie d'exception (question prioritaire de constitutionnalité), depuis la réforme constitutionnelle de juillet 2008, lorsque des droits et libertés garantis par la Constitution sont en jeu. The French Constitution of 4 October 1958 is the current Constitution of France and thus governs the French Fifth Republic. Supreme legal rule of the country, this is one of the most stable it has ever known.

During the war in Algeria, it was written in the stated aim of ending government instability and the risk of military coup; it is marked by the return of a strong executive. Two men in particular printed their ideas: Michel Debré, the British model and Prime Minister strong, and General de Gaulle, hearing erect the president guarantor of institutions in accordance with the principles in his speech of Bayeux, June 16, 1946, and Epinal, September 29, 1946.

It establishes a political system with variable geometry according to whether one is in a period of reconciliation of presidential and legislative majorities or, conversely, of cohabitation. In times of agreement, the National Assembly, the Prime Minister and his government and the president have the same political edge: the president has authority to limit the exercise of constitutional powers of the Prime Minister. Conversely, in periods of cohabitation, the letter of the Constitution is more respected (the President of the Republic François Mitterrand, submitted twice in this case, said that "cohabitation is the Constitution, nothing the Constitution but the entire Constitution ") 1.

Its preamble refers to two fundamental texts of the Declaration on Human Rights and the Citizen of 26 August 1789 and the Preamble of the Constitution of 27 October 1946 (the Charter of the 2004 Environment them subsequently added ). These texts and jurisprudential principles they have revealed, including the fundamental principles recognized by the laws of the Republic from the Preamble to 1946 form with the Constitution strictly speaking, it is called the constitutionality block since the constitutional Council granted constitutional status to the preamble of the Constitution in 19712.

The Constitutional Council verifies the conformity of laws with the Constitution when it is entered, before their promulgation or by way of exception (priority question of constitutionality), since the constitutional reform of July 2008, when the rights and freedoms guaranteed by the Constitution are involved.
