Usulü Fıkıh- Şerhul Verakat (Türkçe-Arapça)

Fıkıh ilmi usûlü, metodolojisi. Usûlü'l-Fıkıh; sözlükte, usûl ve fıkıh kelimelerinden meydana gelmiş bir terkiptir. Usûl, "asl" kelimesinin çoğuludur. "Kökler, asıllar, üzerine bir şey bina edilen şey" manalarınadır. Sözlükte, anlayış anlamına gelen fıkıh ise, din ıstılahında; "Tafsîlî delillerden çıkarılmış olan şer'î-amelî hükümleri bilmektir" şeklinde tarif edilir. Buna göre usulü'l-fıkıh sözlükte; fıkhın asılları, fıkhın delilleri manasına gelmektedir. Usulü'l-fıkıh, ıstılahta "Müctehidin, şer'î amelî hükümleri tafsîlî delillerinden çıkarabilmesi için gerekli olan kural ve prensiplerdir" diye tarif edilmektedir
Bu tariflerden anlaşıldığı üzere usûlü'l-fıkıh bir metodoloji ilmidir. Metotlarını belirlediği ilim ise fıkıhtır. O halde bu ilim fıkıh metodolojisi ilmi demektir. Bu ilme İslâm hukuk metodolojisi denilmesinin uygun olmadığı kanaatindeyiz. Çünkü fıkıh, sadece hukuk ilmi değildir. Hukuk, fıkhın bölümlerinden birisidir. İslâm hukukunun çeşitli dalları fıkıh içerisinde ele alındığı gibi, ibadetler de fıkıh içerisinde yer almaktadır. Dolayısıyla ibadetle ilgili hükümlerin kaynaklardan çıkartılma metotları da usulü'l-fıkıh tarafından belirlenmektedir.
Bilindiği gibi, İslâmî hükümlerin alındığı kaynaklar temelde ikidir. Bunlar Kur'ân ve Hadistir. Fakat her meseleye ait hüküm Kur'ân ve Hadiste her zaman aynıyla mevcut ve açık değildir. Ya da Kur'ân ve Hadisteki lâfızlar, emir, nehy, hass, âm v.s gibi değişik biçimlerde varid olmuştur. Karşısına amelî bir problem çıkan müctehid, bu problemin dînî hükmünü ortaya koymak için Kur'ân'ı ve Hadisi araştırır. O mesele ile ilgili olan âyet veya hadisin ne tür bir kalıpta olduğunu araştırır. Mesela lafız emir kalıbı ile gelmişse, emrin vücup ifade ettiğini bildiren usûl kaidesini göz önüne alarak o hükmün farz olduğuna hükmeder. Cevabını açıkça bulamazsa, hükmü açıkça belirlenen benzer problemlere kıyasla, dinin temel ilkelerini göz önüne alarak ve daha başka temel kaidelerden yararlanarak bu problemleri çözüme kavuşturur. İşte müctehidin hüküm çıkarabilmek için yararlandığı kaideleri tesbit eden ve içeren ilme usûlü'l-fıkıh (fıkıh usûlü) denilir.
